Center Line renames complex for late mayor Hanselman

On Saturday, June 4 the city of Center Line held a ceremony to honor late mayor David W. Hanselman with the renaming of the municipal offices at 10 Mile Road and Lawrence Avenue as the David W. Hanselman Municipal Complex.HANSELMAN-complex-main-800x600

Michigan's Procrustean Deed Restriction Jurisprudence: It is Time to Correct Michigan's Accidental Deed Restriction Caselaw

In 1934, the Michigan Supreme Court cautioned, “Building restriction cases are governed by particular facts, and it is neither possible nor desirable to establish a measuring stick and thereafter cut cases to fit, for that would be too Procrustean.”1 Procrustes is the figure in Greek mythology who chopped or stretched his victims to make them fit into an iron bed. Nearly 80 years after this warning, through a traceable mutation of the law, Michigan courts apply just such a Procrustean measuring stick in deed restriction cases—with the predicted arbitrary, unjust, and incorrect results.

New Receivership Rules, Macomb County Bar Journal, June 2104

The Michigan Supreme Court recently adopted amendments to the Michigan Court Rules pertaining to receivership proceedings. The amendments to MCR 2.621 and MCR 2.622 became effective on May 1, 2014 and include important new provisions regarding the selection of a receiver; receivership orders; a receiver’s power to dispose of personal and real property; a receiver’s disbursement of funds and compensation; bond requirements; and other matters. The amendments provide clarity and specific procedures that should be noted by all practitioners who deal with these issues. This article will highlight some of the most significant changes in the court rules and the likely impact of these changes on receivership proceedings.
